General Terms and Conditions (GTC) of RTG Touristik Foster, Kusnir GbR for Private Tours and Events

1. Contract Conclusion and Booking Fee

  • The contract is concluded upon our acceptance of your booking. A non-refundable booking fee of 30% of the booked services is due upon booking. This fee covers our preparation costs and is not refundable, even in the event of cancellation.
  • The booking confirmation contains all essential contract information.

2. Cancellation Conditions

  • Cancellations are only valid in written form (via email).
  • The following cancellation fees apply (based on the total price of the booked service):
    • Up to 8 calendar days before the tour: 30% of the total price (booking fee)
    • 7 to 48 hours before the tour: 50% of the total price
    • Less than 24 hours before the tour: 100% of the total price
  • Cancellation fees are calculated based on the usual savings and the possibility of reselling the service (§ 651h German Civil Code). The type of tour and our actual costs are taken into account.

3. Changes in the Number of Participants

  • Up to 7 days before the tour, you can reduce the number of participants free of charge, provided the minimum number of participants is not undercut. After this period, reductions are no longer possible.
  • For additional participants, we charge the difference to the booked price plus a processing fee of €20.
  • From 7 days before the tour, an increase in the number of participants is only possible by arrangement.

4. External Service Providers

  • If external services (e.g., bus or boat charters) are booked, the terms and conditions of the respective provider may apply. We will be happy to inform you about the exact conditions upon request. Liability for these services lies solely with the respective provider.

5. Liability and Insurance

  • We are liable for services provided directly by us in accordance with legal provisions.
  • For damages caused by external service providers, only the respective provider is liable.
  • We recommend taking out travel cancellation insurance to cover cancellation costs.

6. Jurisdiction and Applicable Law

  • German law applies. The place of jurisdiction for all disputes is Hamburg, provided the customer is a merchant, a legal entity, or has no residence in Germany.

7. Data Protection

  • The processing of personal data is carried out in accordance with our privacy policy and the provisions of the GDPR.

8. Miscellaneous

    • The customer is obliged to inform us immediately of any defects. Complaints will be acknowledged within 7 days and responded to within 60 days.
